WHAT HAPPENS IN COURT WHEN YOU ARE CHARGED WITH A CRIMINAL CASE?

DAY ONE

The charges are read to you. The same may be one or many. Whatever the number of the charges, they shall all be read to you, and you will be expected to answer whether you are guilty or not. The following are the possible outcomes:

If You Answer Yes

You will be sentenced immediately.

If You Answer Not Guilty

You have a right to bail or bond as the matter will not be heard on that day and you may apply for the same. Bail or bond is a constitutional right, and you are entitled to one. You may be able to meet the bail terms or not.

If you meet the terms, you shall be released, and you will only be appearing in court for either mentions or hearings. If you do not meet the bail terms, you shall be remanded in the prisons, and you will be appearing in courts from there.

DAY 2 AND SUBSEQUENT DATES

When you appear in court in the subsequent days, it will either be for mention or hearings.

During the hearing days, the matter will proceed starting with the prosecution witnesses and finally the court will make a ruling as to whether you have a case to answer or not. If the court decides that you do not have a case to answer you will be acquitted.

If the court decides that you have a case to answer, you will be put in the dock to give your defence. After your defence, the court will make a judgement in the matter either convicting you or acquitting you.

If you are convicted, you have a right to appeal the court’s judgement or meet the sentence terms.
